Family Law

We provide services for divorce; protective orders; modifications of custody, child support, and alimony; temporary separation and separate maintenance; annulment; paternity; adoption; grandparents' rights; pre-marital (pre-nuptial) agreements; and guardianship.

Divorce: we charge a flat fee for uncontested divorces where both spouses agree on custody, child support, alimony, property distribution, and debt division.

Protective Orders: even if you choose to file a petition for a protective order yourself, it is important to have an attorney representing you at the hearing to obtain the result that you want. The Utah Courts’ website has information on how to file a petition for a protective order: www.utcourts.gov

Modifications of Custody, Child Support, and Alimony: iIf you or your ex-spouse’s circumstances change, including loss of employment, significant changes in income, relocation, or disability, we can help you modify your Decree of Divorce to fit the new situation.

Temporary Separation/Separate Maintenance: in certain situations where a divorce is undesirable, we can help you obtain an order of temporary separation or decree of separate maintenance. Such orders or decrees will determine custody, child support, alimony, property distribution, and debt division without divorcing the parties.

Annulment: certain marriages are prohibited from the very beginning and may be declared void. Annulment is a proceeding similar to divorce establishing custody of the children, child support, alimony, property distribution, and debt division.

Paternity: a paternity proceeding determines if a man is a natural father of a child. If paternity is established, a child support and parent-time orders will also enter as part of the proceeding.

Adoption: we help married couples, stepparents, and single adults with adoption proceedings.

Grandparents' Rights: sometimes a parent makes a decision to stop any contact between the grandchildren and the grandparents. Grandparents can petition the court to allow regular visitation with grandchildren.

Pre-marital (Pre-nuptial) Agreements: in certain circumstances, it is advisable to enter into pre-marital agreements prior to marriage. A pre-marital agreement will determine property division, alimony, life insurance benefits, and other issues if a couple later decides to divorce.

Guardianship: a guardianship establishes a legal relationship between an adult and a minor without depriving natural or adoptive parents of their parental rights. A guardianship may be necessary when a child's natural or adoptive parents cannot take care of the child for various reasons.
